Rights Systems and Appeals Processes for Non-Uniformed Federal Employees.

Abstract

There are a plethora of rights systems and appeals processes in the federal service of which employees may avail themselves. They include both the right of workers to organize and be recognized and the right of employee organizations to bargain with management. The second right involves participation in both rule formulation and rule implementation, and has created an inherent conflict between agency regulations and statutory rights. Allied to the conflict over what is negotiable, is the conflict over what is grievable. With the mere stroke of a pen, the President could one day extend just such a system of due process to the armed forces. The inherent conflict between Navy regulations and statutory rights would again surface. (Modified author abstract)
