The Impact of the Legal Doctrine of Apparent Authority Upon DoD Contractual Activities.

Abstract

The doctrine of apparent authority was studied with respect to its implications to Department of Defense contracts in the public and private sectors. Writings on the law of agency were cited, as were court decisions which have established precedents in this area. The formal means of authority delegation in the government has been summarized and it is noted that all legitimate authority derives ultimately from provisions in the Constitution of the United States. It was found that recently the courts and Armed Services Board of Contract Appeals have exhibited a trend toward holding the government liable for the acts of agents possessing only apparent authority. Recommendations are made which should serve to protect the government in such instances. (Modified author abstract)
