Section 847 Requirements for Senior Defense Officials Seeking Employment with Defense Contractors

Abstract

The objectives of our project are aligned with the House Report 114-102 to accompany H.R. 1735, the National Defense Authorization Act for FY 2016, which directed the DoD IG to submit a report by December 31, 2015 (subsequently extended to March 31, 2016), to the congressional defense committees with the following information:(1) The findings of any previous IG reviews to assess whether written opinions are being provided and retained in accordance with Section 847 (provided in Part I of this report).(2) A review of the written ethics opinions that have been requested and provided pursuant to Section 847 and a determination as to whether they comply with Section 847 (provided in Part II of this report).(3) A summary, by Department of Defense organization, of the total number of opinions issued and total number of opinions retained pursuant to Section 847 (provided in Part III of this report).(4) A summary of any referrals to, and complaints received by, the IG or the Department of Justice regarding potential violations of post-employment restrictions, including the final disposition of such cases (provided in Part IV of this report).
