Arbitrary and Capricious A Review of the Navy's Growler Consultation under Section 106 of the National Historic Preservation Act

Abstract

My paper reviewed the Department of the Navy's recent termination of consultation under section 106 of the National Historic Preservation Act regarding the introduction of EA-18G Growlers at Whidbey Island. The paper focused on the Advisory Council on Historic Preservation's post-termination letter to the Secretary of the Navy, which commented on the Navy's handling of the consultation, to determine whether these comments created any litigation risk for the Navy.
