Abstract

Protest that proposal offering listed Canadian end product should have been evaluated pursuant to Buy American Act. restrictions Is denied because regulations implementing Act provide for waiver with respect to listed Canadian end products and GAO has previously upheld DOD's discretion effecting waiver of restrictions and listing products; moreover, action of Canadian Commercial Corporation in submitting offer for Canadian supplier was proper under regulation. In view of Congressional cognizance of Agreements between DOD and Canadian counterpart waiving Act's restrictions, and as Agreement covers matter concerning U.S.-Canadian relations, it is inappropriate for GAO to question regulations' propriety.
