Managing Intellectual Property Relevant to Operating and Sustaining Major U.S. Air Force Weapon Systems

Abstract

In 2018, RAND Project AIR FORCE (PAF) delivered a report to the Air Force Special Operations Command (AFSOC) that detailed issues that AFSOC currently faces regarding technical data and data rights. At the request of the Office of Air Force Deputy General Counsel for Acquisition, PAF extended this research to address the findings of studies mandated by Sections 809, 813, and 875 of the Fiscal Year 2016 National Defense Authorization Act, which were released from 2017 through 2019 and related to the subject of the AFSOC-sponsored research. This report describes ways for the Air Force to improve its policy on and management of technical data and data rights relevant to operating and sustaining major weapon systems. Many of the problems addressed and recommendations developed may be applicable to other types of technical data and data rights problems throughout the Department of Defense. It should interest policymakers and analysts in these organizations responsible for work on technical data and data rights policy. By design, this document does not cover other intellectual property issues of interest to the Air Force. For example, it does not address trademarks registered by the Air Force or patents arising from organic Air Force-funded research.
