Davis-Bacon Act: Army Corps of Engineers Provides Guidance on Wage Requirements, but Opportunities Exist to Improve Monitoring

Abstract

The Davis-Bacon Act, as amended (the Act), requires contractors working on certain federally funded construction projects to pay their workers at least locally prevailing wages, as determined by the Department of Labor (DOL) for various job categories.1 The Act was enacted, in part, to protect workers from contractors hiring lower-wage workers from outside their local area, thus obtaining federal construction contracts by underbidding competitors who pay local wage rates. Each federal agency that contracts for construction work covered by the Act is primarily responsible for enforcing the Acts requirements.
