Commodity Futures Trading Commission - Liabilities Outside of the Governments Control

Abstract

In 2015, you asked GAO to examine the Commodity Futures Trading Commissions (CFTC) use of its authority to lease real property. Some of the lease clauses created uncontrolled liabilities; that is, CFTC did not completely control the total amount of the governments final liability. This opinion addresses the Antideficiency Act consequences of these uncontrolled liabilities and their proper treatment under the recording statute. Our previous work addresses other legal issues arising from these leases.
