The Entitlement of the Soldiery to Due Process in Non-UCMJ Matters that Adversely Affect Them.
Abstract
The American soldiery represents a special group of individuals that come from a society based on the premise of the supremacy of the individual. This premise naturally conflicts with the needs of all institutions. The military is an institution that has a special purpose in society. Because of the growing awareness of individuals of their rights and, because of the multi-ethnic nature of the military, it is essential that a feeling that things are done fairly pervades all of the ranks. The basis for achieving this impression soundly is the development of a due process attitude on the part of commanders and the promulgation of regulations to require that each soldier be given his due process rights in all situations in which his status can be adversely affected.
