Impact of Presidential 50K Call-Up Authority on Deployment of US Corps with Emphasis Upon the War Powers Act.

Abstract

This study analyzes the impact of Public Law 94-286, a section of which granted to the President of the United States the authority to involuntarily order to active duty up to 50K Selected Reservists for 90 days or less without a declaration of war or national emergency, and the War Powers Resolution of 1973 which limits the President's ability to deploy forces into situations where hostilities are clearly imminent or are in fact underway. The study is accomplished within the framework of a theoretical contingency requiring the deployment of a US Corps sized force overseas to an area other than NATO. The history and intent of both pieces of legislation are examined in detail and outlined in a manner useful to commanders and decisionmakers who may be called upon to plan and implement contingency operations within the purvue of these legislations.
