Abstract

The National Environmental Policy Act (NEPA) requires that comments of federal, state and local agencies, which are authorized to develop and enforce environmental standards, be included in an environmental impact statement (EIS). Guidelines and regulations, promulgated by the Council on Environmental Quality (CEQ) for implementation of NEPA, have expanded this requirement so that an agency must prepare a draft EIS (DEIS) and make it available for comment by not only the agencies listed in NEPA, but also Native American Tribes and any persons who may be interested or affected. An affirmative duty is imposed by the CEQ regulations to assess and consider comments both individually and collectively, and to respond to such comments in the FEIS. Substantive comments or summaries thereof are attached to the FEIS.
