Scope of the Marital Privileges Under Military Law.

Abstract

This project consists of a research guide on the topic of martial privileges under military law. The Research Guide is primarily targeted for use by military judges, aimed at providing them with a ready reference to this topic. As such, it is intended to provide the reader both with an understanding of the topic and with ready citations for further research into various aspects of the topic, as necessary. The guide includes an analysis of Military Rule of Evidence 504, Husband-Wife Privilege, discussing and differentiating the testimony privilege of M.R.E. 504(a) and the confidential communications privilege of M.R.E. 504(b), including their distinct backgrounds, evolution at common law, scope of application, exceptions, and waiver provisions. Also discussed are related rules (M.R.E.s 510,511 and 512) and the interplay of the marital privileges with the hearsay rules (particularly M.R.E.s 801, 803 and 804).
