All States Guide to Marriage & Divorce.
Abstract
This book is intended to provide legal assistance officers with a basic understanding of laws controlling the format in and dissolution of marriages. Chapters 1, 2, and 3 are an overview of the laws of marriage, divorce, and legal separation. Chapter 4 contains sample separation agreement provisions as references for preparation and drafting of the instruments. Chapter 5 provides summaries of state and territorial laws and procedures concerning marriage and divorce. Legal assistance officers are advised that these state and territorial laws are subject to amendment by legislature and interpretation by courts. Legal assistance officers also are advised that the sample separation agreement provisions in Chapter 4 are presented to aid you in the preparation of these agreements. These forms should not be used in whole or in part without a thorough understanding of the purpose and effect of each provision. This text does not purport to promulgate Department of the Army policy or to be directory in any sense. A legal assistance officer, while giving legal advice on a domestic relations problem, may also determine that th client needs or desires advice on related non-legal matters. The legal assistance officer should avoid non-legal counseling on domestic relations matters. Depending on the circumstances, he or she should provide legal advice only (or defer giving such advice) and refer the client to a chaplain, psychiatrist, medical doctor, marriage counselor, or appropriate sociological assistance.
