Repair, Evaluation, Maintenance, and Rehabilitation Research Program. Applicability of Environmental Laws to REMR Activities.
Abstract
The commitment to protect, conserve, and enhance the environment has been expressed in numerous far-reaching laws, statutes, and regulations. These environmental laws apply to private and government agency planning, construction, and operations and maintenance (O&M) activities. The O&M procedures developed under the Repair, Evaluation, Maintenance, and Rehabilitation (REMR) Research Program might result in wastewater discharges, destruction of fish and wildlife habitat, use/disposal of hazardous or toxic materials, or other activities covered by environmental laws. The environmental laws and regulations were examined to determine their applicability to REMR activities. The laws were classified as compliance statutes, statutes applicable in certain cases, or secondary environmental laws, depending on the intent of the law and characteristics of REMR activities. The purpose of each law is explained and the types of REMR activities that could be covered by the law are identified.
