Resolving Contract Disputes

Abstract

The purpose of this report was to investigate and evaluate the manner in which contract claims and disputes were handled and settled within the Army Materiel Command. This study was performed as the result of concerns raised by the Office of the Chief Trial Attorney (Army). It was found that generally, the system seemed to be working properly but individual and Major Subordinate Command philosophies did impact the settlement of claims at the contracting officer level. It was recommended that the Army Federal Acquisition Regulation Supplement be amended to clearly state the Army policy so that a more uniform approach to contract claims settlements could be institutionalized.
