Regulatory Relief: Simplifying and Eliminating Contract Clauses. Volume 2
Abstract
This report sets forth our analysis of the 1,090 solicitation provisions, contract clauses, and alternates in the Federal Acquisition Regulation (FAR) and the DoD FAR Supplement (DFARS). Contract clauses and solicitation provisions - hereafter simply called 'clauses' - are a principal means of implementing the policies contained in the acquisition regulations. The report presents such information about the clauses as whether their origin is statutory or nonstatutory. 'Statutory' is used here to embrace clauses based on law, Executive order, Office of Management and Budget (OBM) circular, Office of Federal Procurement Policy (OFPP) policy letter, other executive branch directive, or nonprocurement regulation published in the Code of Federal Regulations. The report also indicates whether the clause flows down to subcontractors and the tier to which flowdown occurs. Finally, Chapter 4 arrays the 639 clauses (including alternates) from the FAR, also in numerical order by part.
