An Examination of Wetland Programs: Opportunities for Compensatory Mitigation,

Abstract

Fee-based compensatory mitigation can be attractive to permittee, regulator, and conservation interests. It enables the consolidation and more timely response to mitigation needs through fewer, larger wetland projects achieving economies of scale in terms of planning, construction, and other aspects of project implementation. Such programs can also provide greater ecological viability, greater probability of success, and greater ease of monitoring and management, and can also be established to focus greater attention on those restorations that complement regional wetland priorities. Existing programs that implement or facilitate wetland restoration, creation, or enhancement projects could also benefit from implementing compensatory mitigation. Under alternative arrangements, such programs could pool and coordinate the use of mitigation fees. This report identifies programs that, if given the appropriate implementation vehicle, could potentially accommodate fee-based compensation arrangements in the future. Brief profiles were prepared for 14 Federal, 9 state, and 6 nonprofit organization programs with potential for accommodating mitigation requirements.
