Public-Private Competitions; Review of Sacramento Air Force Depot Solicitation

Abstract

Several laws govern the solicitation and selection of offerors to perform depot workloads. Section 2469a of title 10 of the United States Code provides for special procedures for public-private competitions at the closing Sacramento and San Antonio depots. In particular, section 2469a sets forth certain elements that must be reflected in the solicitation and considered in making the selection of the source for the performance of the workloads. These include requirements that all estimated savings and costs to the Department of Defense (DOD) related to the award must be considered, and that no offeror may be given preferential consideration for, or be limited to, performing the work at a particular location.
