Community Environmental Response Facilitation Act Letter Report. Military Ocean Terminal, Bayonne, Bayonne, New Jersey

Abstract

In October 1992, the President Bush signed into law, the Community Environmental Response Facilitation Act (CERFA), Public Law 102-426. CERFA amended Section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), establishing new requirements with respect to contamination assessment, cleanup, and regulatory agency notification/ concurrence for closing federal facilities and transferring property. In March 1995, the Base Realignment and Closure (BRAC) Commission submitted its recommendation to close the Military Ocean Terminal, Bayonne (MOTBY), located in Bayonne, New Jersey. Under CERFA, the Department of the Army is required to "expeditiously identify real property that offers the greatest opportunity for reuse and redevelopment" at closing facilities such as MOTBY. The first step in identifying such property is determining the location of real property where no CERCLA-regulated hazardous substances or petroleum or their derivatives were stored for one year or more, known to have been released, or disposed of. This letter report provides the preliminary findings for classifying parcels at MOTBY that may become eligible for transfer.
