Policy for Treatment of Detainees by the United States Military

Abstract

Public Law No. 109-148 was enacted in December 2005. This law prohibits torture and cruel, inhumane, and degrading treatment of detainees held by officials of the United States. Does this law establish the correct position on the treatment of detainees? What should the policy be for the treatment of persons detained by the United States military during the war on terrorism, and how does it affect the larger war on terrorism? This paper will provide historical background information, analyze the implications of this information, review U.S. policy for the treatment of detainees, and recommend a policy for the treatment of detainees.
