Due Process Standards and Considerations Regarding Suspension and Debarment

Abstract

This thesis sets out the regulatory provisions of the suspension and debarment provisions of the Federal Acquisition Regulations and explores their basis and development. The development of due process standards as applied to the suspension and debarment provisions are analyzed and a suggestion for a different focus in future judicial review is offered. The thesis concludes that the suspension and debarment provisions are an appropriate exercise of the government's contracting power and should be able to withstand future challenges if the provisions are appropriately applied.
