Pretrial Agreements in the Military Past and Future

Abstract

This thesis examines the development of negotiated guilty plea practice in the military from 1953 to the present, and makes proposals for future development. This thesis concludes that the present restrictions on initiation of pretrial agreement negotiations are unnecessary, and that restrictions on the terms or conditions in such agreements are overbroad.
