The 21st Century FBI: A Domestic National Security Mission Under the Rule of Law

Abstract

This paper examines the historical role of the FBI in order to promote a vision for its 21st century mission. In particular, throughout its history, the FBI has been called upon to address domestic national security issues while performing the unique and important law enforcement duties under its jurisdiction. It has evolved over the last century to confront the nation's domestic security threats in a constitutionally acceptable manner. In the aftermath of the events of September 11, 2001, caution is warranted as many pundits and critics have called for the creation of a domestic intelligence agency capable of preventing future acts of terror on American soil. This paper posits that the FBI's legacy and professional culture are well-suited for the domestic security mission, while maintaining and adhering to its investigative unpinnings guided by the rule of law and protection of civil liberties.
