Current Law Limits the State Department's Authority to Manage Certain Overseas Properties Cost Effectively
Abstract
The Department of State is the central manager for real estate at U.S. embassies and consulates and has the statutory authority to sell properties and use the sales proceeds to acquire and maintain other overseas properties. Section 738 in the fiscal year 2001 Agriculture Appropriations Act prohibits State from selling residences purchased to house agricultural attaches without approval from the Foreign Agricultural Service (FAS) and requires the department to use the proceeds from such sales to purchase residences for these attaches. Legislation currently before the Congress would repeal section 738. This report discusses the effect of section 738 on State's management of overseas properties.
